Is Troy Maxson a “Tragic Hero?”

A tragic hero is a character who used to do good deeds in the light of others but allows for his flaws or inner struggles to overcome him. As a result, this downfall leads to the character’s death. In the case of Troy Maxson, main character from the play â€Å"Fences† by August Wilson, it is clear that he constantly struggles to keep up with good deeds for his family, but unfortunately allowed his inner flaws to lead him to his lonely and tragic death. Therefore, Troy Maxson is indeed considered a tragic hero and there are pieces of evidence throughout the aforementioned play that further proves my point. Troy Maxson is a man with two sons by the name of Cory and Lyons Maxson. He had Lyons before he went to jail with one woman and had Cory after jail with Rose Maxson; his current wife. His character is made up of both positive and negative attributes. He can be described as controlling because he has all the authority during the beginning of the story when Cory brings up an opportunity in getting into college football. When this idea is brought onto Troy’s table, his immediate response was to say no. The reason for this action was clear. He was protecting his son from having high hopes because he believed the color barrier was not broken. Although he said no to Cory’s opportunity, he was being a hero in his own way. Troy Maxson was known to be the breadwinner of the family. He provided for his wife and his son which is why he was respected. His characteristics were that of a powerful man. Rose asks Troy â€Å"what you all out here getting into? † And he responds â€Å"what you worried about what we getting into for? This is men talk, woman† (1. 1. 41-1. 1. 42). This quote gives an example of his strong masculinity characteristics. He struggled a lot when he was younger living with his father. His father did not provide for the family materialistically or emotionally. Growing up to this horrible lifestyle, Troy was either going to learn, grow, and live by example, or completely live his own life. He decided to live by example and do the opposite of what his father did. Although there were a couple of mistakes he made, he made sure he did not make the same mistake his dad made which was not providing for the family. Rose was Troy’s wife who respected him as a husband and made him and her children dinner every night. According to what he says, he truly loves his wife; â€Å"I love this woman. I love this woman so much it hurts. I love her so much†¦ I done run out of ways of loving her† (1. 1. 173). This quote allows the reader to realize that the Maxson family does have a foundation of love. Cory and Lyons also admired their father because in their eyes he was an excellent father figure. Bono was Troy’s best friend whom he met at a correction center and has known him for 30 years. Troy was a role model to Bono and he admired Troy's leadership and responsibility at work. After understanding the protagonist’s heroic side, it is necessary to understand that he also had a tragic downfall and that he has certain weaknesses. Troy made sure to provide for his family materialistically, but unfortunately did not expose too much of his love to his children. He was able to reluctantly give Lyons ten dollars a week but that was not enough to help him make a living. Lyons states â€Å"I just stay with my music because that's the only way I can find to live in the world† (1. 1. 153). His dream is to be a musician. But maybe he needed more than ten dollars a week to conquer his dream? Maybe he needed some father to son affection? Maybe being separated from his dad at such an early age affected him emotionally? He did not care for him so this in turn helped Lyons become more independent. Regardless of the lack of emotional support from Troy, he continues aspiring to reach his goal. Troy can also be considered a hero because he allows Lyons to be an independent man. Troy was known to be jealous of Cory because he got the opportunity to play a sport without discrimination against his race. Cory expressed his feelings to his dad in this quote: â€Å"Papa done went up to the school and told Coach Zellman I can't play football no more. †¦ Told him to tell the recruiter not to come†¦. Just cause you didn't have a chance! You just scared I'm gonna be better than you, that's all. † (1. 4. 158-1. 4. 166) Cory is clearly stressing the fact that his father said no and blames it on his jealousy, but what he does not realize is that his father is also trying to protect him from discrimination. The reason why Troy has this mentality is because he grew loving sports, just like his son, during the time of the Negro Leagues. He was discriminated against and he thinks that that is what Cory would go through. He might have been jealous, but he also played a heroic figure by protecting his son. Towards the end of the play Troy seems to be continuing his path down â€Å"tragic lane†. He betrays his wife by cheating on her with another woman, Alberta, and impregnating her. Alberta has her daughter but dies in the act of giving birth. Troy is left with no choice but to care for his daughter. Rose cuts it off with Troy, but not completely because they still live under the same roof. She is more independent now and leaves the house when she pleases. Troy’s relationship with Bono, Cory and Rose changed immensely. He has lost his respect and it will be very challenging for him to redeem it. Bono has made new friends and stops by Troy’s house once in a while. They talk about their hopes for their future and about their wives. They no longer work in the same industry so after work Troy has no one to talk to. Cory and his father are not in good shape either. The scene where Troy sits in his backyard after pay day to drink his gin and sing is when he picks a dramatic fight with his son. Cory refuses to say â€Å"excuse me† when passing by his father so Troy gets offended and tries to assert his role as a father by insisting that Cory leave his house and provide for himself since he lost his respect as the man of the house. He goes on by saying â€Å"You just another nigger on the street to me! † (2. 4. ). He also stresses to his son that he provided for him but Cory does not take that into consideration because to him that was all materialistic. He gave little loving care which ultimately made him fear his own father. Although Troy kicked his son out of his house, the fact that there was a physical blockade during their fight, it proves that it was immature on Troy’s part yet mature on Cory’s because of the way he went about the situation. Cory scolded his father for all his wrong doings and betrayals to the family. He challenges him to a physical fight, in his case involving a bat, just like Troy did to his father. Troy is a hero in the sense that he pushed Cory into manhood. Troy is alone. He is lonely. His life is not the same anymore. He tried his best by providing for his family and by showing his new daughter his better side of him. When Troy died caused by a heart attack, he left his legend as a hero behind. He supported Lyons with money each week; he provided his love to Rose; his friendship and leadership to Bono; and finally his protection and help for Cory’s future. Unfortunately, he allowed for his personal demon or flaw to â€Å"get the best of him† which led him to his death, but did good deeds in the lights of others giving Troy Maxson the title of a Tragic Hero.

Case 9-1 PERFROMING RIGHT SOCIETY, LIMITED v. HICKEY Judicial Body: Zambia, High Court at Lusaka, 1978, Judge Sakala Facts: Copyright infringement, Innocence of infringement; Injunction for damages Issue: Defendant played records of copyright music during a public performance. Defendant also performed the song without the permission of the copyright owner. This is an infringement and the song’s composer wants to be compensated for the use of his song. History: Defendant violated copyright laws by performing and playing records at his disco. Defendant did admit, but did not understand that he had violated any law. Plaintiff filed for an injunction of damages, and any profits earned during the time that his songs were performed and played. Decision: Zambia, High Court at Lusaka ruled that the defendant was not clear about the copyright laws and did not intentionally set out to violate the laws. The court ordered that defendant would be liable for any profits made the night of the disco. Relevancy: This case provides a reminder that any invasion of a right of property gives cause of action to the owner against the person responsible for the invasion, regardless it was intentional or not. If an infringement is admitted , but at the time of the infringement the defendant was not aware and had no reasonable grounds for suspecting copyright subsisted in the work , or other subject matter to which the action relates, plaintiff is not entitled to damages , but is entitled to an account of profits. The judge was very understanding; defendant claims that he was not aware of copyright infringement. I think one needs to consider moral rights, as a business owner, one knows that licenses are usually needed to run a restaurant , disco , and club. A license is needed for the business establishment, a license if needed to serve alcohol, I suppose it slipped his mind in regards to the music he chose to play and perform. Given below are the instructions of how to go about hosting a dinner for six persons. Instructions By following instructions step by step we not only find that a job becomes easier but it avoids a lot of confusion and makes it more methodical and systematic. Step -1 – Cleanliness is of utmost importance and therefore the kitchen, the dining table and the surroundings should be thoroughly cleaned with disinfectant. Step - 2 – Utensils and food stuff should be washed thoroughly before making use of them. Serving dishes should be washed well and dried with a clean towel before using them to serve. Step – 3 – The Menu should be made out well in advance and the ingredients for preparation should be purchased at l east a day ahead of the dinner and that includes even the desert. Step- 4 - Menu – Preparation of Chicken Fried rice, Chicken fry and Caramel custard. To serve – 6 persons Things needed – 2 Kgs. of chicken, 1 Kg. rice, 100 gms. each of carrot, beans and peas, 4 big onions, ? kg. tomatoes, saffron, ginger and garlic paste, spices, hot chilly peppers, ground pepper, oil, green coriander and salt to taste. For the Caramel custard we need 4 eggs, 2 cups of milk, 200 gms. of sugar and few drops of vanilla and a dash of nutmeg. Step 5 - Preparation 1. Chicken Fried rice: Wash the rice thoroughly and keep aside. Boil the chicken after washing with a little salt and ? teaspoon of saffron. Remove ? kilo and once again saute in a pan with either oil or ghee. When cool, shred and keep aside. Chop 2 big onions and 4 tomatoes and keep them covered in separate dishes. For the vegetables a grater could be made use of or chop them finely lengthwise after washing them. Heat 3 to 4 tablespoons of oil in a medium sized utensil and when hot enough put in the onions and fry till golden brown. Add ? a teaspoon of saffron and stir. Put in the tomatoes and diced vegetable and fry well. When cooked well put in the shredded chicken, some spices and diced chilly peppers with sufficient salt to taste. Cover and let it simmer well for 5 mins. Put in the washed rice and pour 10 cups of water. Cover with a lid and cook for another 15 mins. Serve while hot. Chicken Fried Rice 2. Chicken Fry: Heat 4 tablespoons of oil in a deep pan. Toss in the diced onions and fry till golden brown. Put in ? a teaspoon of turmeric powder and stir. Add15gms. of ginger - garlic paste and fry well. Put in 1 teaspoon of red chilly powder and ? a teaspoon of black pepper and fry them well. Toss in the diced tomatoes with sufficient salt and fry well. Finally add the pre-cooked chicken and mix well in the masala after adding sufficient salt. Cover the vessel and cook again for about 10 to 15mi ns. Garnish it with finely chopped green coriander leaves and serve while hot. Chicken Fry 3. Caramel Custard: In a baking dish heat 3 to 4 tablespoons of sugar till it melts and gets burnt and spreads evenly at the bottom and sides of the dish. In another dish beat the eggs, milk, sugar and Vanilla essence well till the sugar dissolves completely. Gently strain this mixture into the dish with the burnt sugar. Scrape a little nutmeg powder over the top of the mixture and cover the mouth of the deep pan with butter paper. Place this dish in a pressure cooker and cook for 10 mins. Serve while cool. But by then, I was hooked†. Similarly, when Repairman’s mother â€Å"great gleaming mother Flora† who is â€Å"a perfect 50s housewife carrying a basket of dirty laundry† enters the scene. Why is it that a perfect 50s housewife, all gleaming and with â€Å"fluoroscopic eyes† and who sees every filth and dirt in her son’s clothes, unable to inform his son that the washing machine is not a television? And definitely, the absurd idea of what is a perfect housewife in this play is humorous, making the mocking undertone realistic and hitting its mark. These are just a few samples, but the play is packed with these puns from start to finish.

This action requiers a lot of responsibility, it takes a short time to judges a person, but it needs quite long time to make it right. When it comes to the first judgment of a persons character, many people the appearance as their criterian. However, in my point of view, this is not a wise to make the real judgment of a person. Ussualy people conclude poeple so fast becuase they are looking from the outside. You know what the said dont judge the books by its cover. Meaning that by looking at a book you think it is bad when you didnt even read the prologue yet or even the back of the book. This quote tell you to judge people from their personality, just like judging a book people wont read if the cover page is ugly and that is the mistakes that they are making. The point is judging people from their first imperssion is not wrong, but it ussually does, why dont you g ive him or her a chance. Taking a conclusion of someone may set your mind forever about that person and you wont know tha truth about that person unless you giver him or her a chance and you will change your mind either making it better or worse. Another good policy is to remember that everything is not about us. Time is needed to came up with a precise conclusion , People act different from others and some people have their own kind of way of gestures. Not everyone is born the same, that is why it makes every one unique in their own way. First impressions arent a good thing and it shouldnt be done. You have to get to know the person first before you judge them! Once you get to know the person, then you can judge them by who they are. It takes more time and effort to really get to know a person before judging them.   Im not sure if we can totally override our preconceptions, but I think we must try to quiet them while we delve deeper.   The color of a persons skin shouldnt matter nor should their age, sex, weight, or what clothes they wear.   There are many interesting, smart, and valuable people that dont fit the mold that our society has created.   It is up to us to decide how we will judge people. It is human nature to judge others based upon initial impressions. We may pretend that it is otherwise, however, we all form first impressions which are difficult to undo in our minds. We may train ourselves to open our minds and not allow our first impressions to close doors; however it remains in our nature to judge. If we use our intellect rather than our emotional response we will remain open too learning about people despite our first impressions, even find that we were mistaken in our initial judgments. There are many things about a person that we judge based upon our life experiences that have no relevance to theirs, this often leads to mistakes. There is also the issue of what is within the control of the person that we are meeting for the first time and what is outside of their control. Leaping to judgment based upon our own experiences and expectations can only lead too lost opportunities that enrich our lives. In short its better if we don not judge people, but if it is necessary dont judge them in their first impression.

Seraglio: An analysis ‘Seraglio centers on a fundamental mystery: the complexities of a husband and wifes relationship. The barrier that they experience between them is further emphasized through being from two different cultures, which is portrayed as almost being from two different worlds, ‘close but not touching, like two continents, each with its own customs and history, between which there is no bridge. It is evident that Swift sets this barrier from the start as his interesting choice of title refers to a room where the women are kept secluded from the men. The narration is in first person singular and is enhanced by the main protagonist the husband. The exotic setting which the characters are indulged in, contrasts deeply with the dark events that have the taken place in their lives; the husbands affair, his wifes miscarriage, the misfortune of not being able to have children in the future and the ways in which they try to mentally escape from these woes. Cosmic irony is common in Swifts work as his characters are hardly ever happy, and when they are, the feeling is almost alien to them. ‘Seraglio seems to defy the common story structure as there is no solution to the predicaments the characters face. The husband as a flat character means he has no function other than to provide us with the narrative, which is useful to us as readers when interpreting the essentials of the story. Swifts preservation of names and detail of the characters lives evokes further curiosity in the reader, proposing a desire for us to learn more about the characters. In comparison, if we look at swift himself, the Telegraph states ‘No contemporary author is such a closed book, indicating that his characters may be mirroring himself. In contrast to the lack in detail of the characters, Swift is quite descriptive when illustrating the city, possibly to indulge the readers attention further into the story. When it comes to the husbands personal life such as his current marriage, he makes more use of narrative passages, leaving the reader to dig in further for clues about the couple. It is as if Swift uses these narrative passages as a device for the author to piece certain things together, including the sensitivity of the couples relationship and the feelings associated. In ‘A Family Man, Pritchett narrates in third person whilst introducing to us the main protagonist Berenice, a woman who is involved in a ‘piquant affair with William Cork. We sense that it is on the verge of being discovered when Florence (Mrs. Cork) enters the story, ‘a large ponderous woman who immediately grips the readers attention due to this presentation of her. Initially, the reader is drawn to her size, but later it is who she really is that keeps us drawn to her further. Pritchett also injects curiosity into the story when describing how one character is towards the other, in this case, Berenice with Florence as the reader is stepping into her shoes and experiencing what she feels and how she reacts. The author uses her as a tool to aid us in interpreting this, as we are placed only in her shoes. Pritchett makes this easier for us as we read of Berenices character from a third person limited point of view. The tension is soon created when Florence reveals herself to be Mrs. Cork, the wife of William Cork, and continues to mount throughout the story as we observe how the two characters react with each other. Pritchett presents to us the two women meeting for the first time, at first humble towards each other but eventually confrontational, ‘Is that what he has been stuffing you up with? I know what you and he are up to. Florence is indefinite about the affair, however the reader knows completely well that it occurred, indicating elements of dramatic irony within the story. However, we are also left in the dark as much as Florence is when it comes to knowing the precise details of the affair (for example when it started), creating further suspense and mystery. Berenice is a dynamic character, in that she lies to Florence and changes her story to get around the difficult situation she finds herself in. We see another side to her, especially as Pritchett states in the beginning, ‘She had been brought up by Quakers and thought it wrong to tell or act a lie. This affirmation completely contradicts what she does later, creating a complex in her character. She encounters conflict and transforms as a result of it. On the other hand, Florence serves as a flat character as there are no multidimensional traits in her personality. Also, she is readily recognized as the adulterers wife, making her a stock character. Evidently, Prichett may have placed her there to bring out the multidimensional traits in Benerice. The other flat character in the story is Mrs. Brewster, whos involvement in the novel is minimal, but her importance is great. It is through her words that we view (for the first time) another outlook on Benerice. After thinking Benerice would have learnt her lesson in regard to nearly getting caught by Mrs. Cork, Benerice visits another couple and we see elements of a flirty nature through Mrs. Brewsters view of her, ‘She ought to get married†¦I wish she wouldnt swoosh her hair around like that. Through this ironic ending, Pritchett is almost alluding to a possible recurrence of another affair with a married man (Mrs. Brewsters husband?), which presents the reader with a whole new series of events to look forward to. ‘The Prophets Hair portrays a family from the valley of Kashmir who are broken by a strand of the Muslim prophet Mohammeds hair. This story is full of overtones, regarding the effects of religion on others, and the way in which corruption is associated with money. Ultimately, Rushdie highlights two strong forces within our society: money and religion, and how they conflict with each other. In the end, the hair itself raises this point through the way it affects each character; the materialistic Hashim family and Sheikh Sin the thief who craves jewels, who all perish eventually. The opening of the story is filled with overtones of religion and money, which are emphasized from the start as we learn that Hashim is a ‘money-lender and ‘not a godly man. From the beginning we are informed that Hashim sees value in nothing else but money. Also, on discovering the religious trinket, Hashim immediately thinks of ‘American millionaires who buy stolen paintings and hide them away, which may suggest one of his thought processes of wanting to sell the phial in future. Hashim is a dynamic character and Rushdie demonstrates extreme contrasts and complexities in his character: the protagonist starts off as an atheist then transforms into (what he thinks) a deeply religious individual (even though he continues to beat others and has sinned to his wife), imposing strict religious acts onto his family. His character also becomes dislikeable to the audience after the effects of the Prophets hair. On discovering the find, he does not do the honorable thing of returning it to the shine. The reader expects this as we learnt in the beginning that ‘he set great store by ‘living honorably in the world, however, his actions were not honorable and resemble that of a thief. In contrast to Hashim, Atta is a flat character in that he does not undergo any change throughout the course of the story. Rushdie may have used him as a device to enhance the plot as he is at one point involved in removing the religious trinket from the home, and also represents the familys wealth in the opening scene. He also wakes up Hashim in the end, causing a series of unfortunate events to unfold.Huma is one of the main protagonists alongside her father, who also enhances the plot (perhaps more than Atta) as she introduces Sheikh Sin to the situation. She evokes pathos in the reader, and we can empathize with her more than Atta, as she is victimized by her father for no reason, whereas in the beginning Atta lands himself in trouble when looking for a thief, which the reader may interpret as foolish behavior. Other round characters include Sheikh Sin and his wife. She is a round character as she evokes interest in the reader in regards to how she got her vision back when her husband was killed.Rushdies use of symbolism is extensive throughout the story. I believe the religious trinket may symbolize the two elements of corruption involved in our society, folded into one. The phial has a monetary value whilst the hair contains great spiritual value. To attain the prophets hair is selfish and wrong, but the monetary value of the phial is greatly desired by all, possibly symbolizing that these two elements are not compatible with each other. Fiona Richards from the University of Leeds also states, ‘It illustrates the extent to which the icons meaning is determined by the context in which it is placed, and its ability to subvert and destabilize the limits placed upon its meaning by such a framing. Rushdie also prepares the reader with the series of events that are to occur, ‘the glassy contentment of that house hold, of that life of porcelain delicacy and alabaster sensibilities, was to be shattered beyond all hope of repair, indulging the readers interest further. Rushdie also induces cultural references through his use of words from the Kashmiri language, such as ‘kukri knives and ‘shikara. This gives the reader an insight into the culture by revealing to us different Kashmiri words. He is slightly expanding our knowledge of the Kashmiri culture here. ‘The Prophets Hair ends ironically, as the religious trinket aids poor Sheikh Sins wife and disabled children but destroys the wealthy Hashim and his family. In the end, it only worked for those who truly needed it. Weldons Weekend presents the habitual and normality of a standard middle class family, and the pressures that the main protagonist Martha faces. Weldon, who is a feminist also challenges conventional feminism here. The story is illustrated from an omniscient point of view, as Martha and at times Martins thoughts are revealed to the reader. The author portrays Martha as a perfect, loyal and hard-working wife, but her efforts are unappreciated by her dominating husband Martin, who she tries hard to please but (sometimes) gets stern looks from him. As the story follows, it is evident that Marthas daily struggle of being the perfect mother to her kids, keeping life organized and maintaining Martins satisfaction has had an effect on her mind state, to an extent that her thoughts have been tormented by fear and paranoia, ‘You dont want his secretary providing a passion you neglected to develop. Do you? The presence of Katie (Collins new wife after Janet) may also trigger Marthas paranoia as she represents what Martin could have after Martha. In her desperation to please Martin, Martha also changes her thoughts and ways to match that of Martins, ‘No such thing as an accident. Accidents are Freudian slips: they are wilful, bad tempered things. Although it appears as Martha is speaking, this is actually something Martin may have conditioned her to think. Her own thoughts have transformed to reflect Martins. The story contains heavy themes of gender stereotype and gender inequality. Weldon alludes to this when talking about the cars; Martin has a posh ‘sports car whilst Martha drives ‘an old estate car. Also, the reader can notice that Martin tends to do the ‘manly jobs such as driving and lighting the fire, whereas Martha cooks and cleans. Predominately, Martin is the dominant force in the story and Martha is the secondary force, who is threatened. Martha is also associated with further negative connotations, such as complaining too much, being paranoid and dull, and at times slow. This could represent the modern attitudes of housewives as they dont work but stay at home all day. This idea is further emphasized when we see elements of quoted dialogue from Martin. He mainly speaks in imperatives to her, ‘You shouldnt have bought it so ripe, Martha ‘Be honest now!This creates tension in the reader as one may get tired of hearing demand after demand. This also enables us to experience the restlessness Martha may feel. Martha contrasts to Katie, who is childlike in stature and also in manner, as Martha cannot trust her in the kitchen. She can also be viewed as being more independent than Katie, as Katie is ‘in [her] mid thirties with nothing at all to her name, neither husband, nor children, nor property. However, in the story it is almost as if Martha feels threatened by Katie because Martin states that she is ‘exciting and ‘wonderful and has restored Collins youth. Weldon cleverly reveals to the reader Collin and Janets past relationship to symbolize what could occur if Martin was not satisfied with Martha; he could find someone like Katie who is more extrovert and relaxed, and who could ‘bring out the youth in him. We learn that Janet was also ‘dull and quieter than her husband just as Martha is.The ending can be viewed as either being pessimistic or optimistic. Is it that Jenny has motherhood, marriage and friendship to look forward to? Or are these the things that she will find hard to embrace? In the end, Weldon leaves the reader to assume their own opinions. The story of Philomela is told in first person narrative, and it is Philomelas sister Procne who narrates the story. This contradicts the readers expectations as the title is ‘Philomela, so initially, we expect the story to be from from her point of view. Procne narrates in a cold and firm tone throughout the story, which creates more pathos without any extra detail being needed to create this mood.The reader cannot help but notice comparisons with Ovids tale of Philomela as it is a much more detailed version, providing an elaborate account of Philomelas suffering. On the other hand Tennant has cleverly condensed her version of the story, leaving the reader to conjure up thoughts about what might have happened themselves. On killing her son, the reader can still empathise with Procne when she states, ‘Years and years will pass, and these minutes will still be longer than them all. Every hour will be made up out of them. Although she keeps an unemotional tone during this scene, Tennant still informs the reader that this tragedy will never escape her mind, engaging our sympathies with her. Tennants use of symbolism is reflected through the birds in the story, ‘I moped, like the birds my children bring back when they go out for a walk. Procne associates herself with these birds, and this association may allude to the women of that era who werent allowed to speak out, who didnt have a voice. The absence of Philomela has led the grief-stricken Procne to isolate herself, and it is the sound of birds that is the only thing which keeps her content, ‘It was summer, and birds were singing in the thicket of olives. This could perhaps forshadow the events that are to occur, as the birds are the only thing which give her hope and also represent the voiceless women, particularly Philomela who will give her the power to avenge later. Procne turns from a grief-stricken sister to a murderer and an avenger. These complexities in her character cause her to be a dynamic one. Philomela is also a dynamic character as she encounters conflict and is changed by it. She also introduces and enhances the plot. She evokes the anger and hostility needed towards her husband in order to carry out the revenge, ‘She reached my side and took my hand so I could rise with new strength. On the other hand, Tereus is a flat character because he has no other function other than to serve as a villain in the story, who offers to take Philomela to Thrace but then rapes her.Isyth is a flat character as he has no major involvement in the story apart from being served on a plate to his father and used as part of revenge. Procne constantly describes Philomelas physical features, ‘I watched her all the time- for signs of happiness, or discontent, or simply to see what her eyes would say to me. Her eyes which speak their own language provide the reader with an insight into how she feels, as this is the only way we can understand her. The Importance of Justice in Society One component of the definition of justice is the final outcome of the process of the law, whereby justice is distributed by the State. According to this definition, justice is the mechanical process of the structure of law – set in place and agreed to by the people of the State. Another definition is concerned with the value inherent in ‘just’ behavior. One distinction between these two definitions is the difference between an individual viewpoint and the larger view of the society. Either view incorporates the concept of moral judgment; ‘good’ as opposed to ‘bad.’ Man has recognized the importance of justice in his society since the earliest of times. In order to serve justice, there has to be a law to settle differences among the people of the state. The history of law in relation to society reveals that humanity’s earliest efforts at lawmaking were prompted by the basic desire of self-preservation. Although engulfed by a society that necessitated such combinations as clans and tribes for protection, as well as for social and economic advancement, the nature of the individual led to the development of certain expressed general rights with regard to person and property1. Generally, these unwritten rules governing social and economic interaction recognized the right to defend oneself from injury as well as to enjoy property without outside interference. While sufficient for primitive societies, unwritten rules of social control were ineffective in a rapidly developing society. So, an effort was made to clarify them so that all the peop le would know their definitions, limits, and applications. After reading Fuller’s Speluncean Explorers fictional case and seeing the conflict... ...een the poor and rich, the weak and the strong. To fight poverty the state should spend more money on education, employment, and child welfare. The state must give the individual his rightful place of dignity as a free man equal to all his fellow men where he shall have the right to live under a rule of law based on a sense of obligation. In Judith Minty's story "Killing the Bear", a woman finds herself in just such a situation. She finally deals with something that happened to her as a young child that she probably never even realized was bothering her. In this story the central character painfully comes to grips with a major loss of security from her childhood. Throughout "Killing the Bear" the author flips back and forth from the story at hand and seemingly only loosely related anecdotes about the main character and bears. One of the first of these side stories is about the woman's childhood. It talks about something that happens to most children, the loss of an object of security. The girl is attached to a stuffed bear and her mother takes it away "for three months" (12). She is told that when the time is over if she has stopped sucking her thumb, she can have the toy back. International Joint venture Essay

International Joint Ventures (IJVs) are becoming increasingly popular in the business world as they aid companies to form strategic alliances. These strategic alliances allow companies to gain competitive advantage through access to a partner’s resources, including markets, technologies, capital and people. International Joint Ventures are viewed as a practical vehicle for knowledge transfer, such as technology transfer, from multinational expertise to local companies, and such knowledge transfer can contribute to the performance improvement of local companies. Within IJV’s one or more of the parties is located where the operations of the IJV take place and also involve a local and foreign company. Basic Elements of an IJV Contractual Agreement. IJVs are established by express contracts that consist of one or more agreements involving two or more individuals or organizations and that are entered into for a specific business purpose. Specific Limited Purpose and Duration. IJVs are formed for a specific business objective and can have a limited life span or be long-term. IJVs are frequently established for a limited duration because (a) the complementary activities involve a limited amount of assets; (b) the complementary assets have only a limited service life; and/or (c) the complementary production activities will be of only limited efficacy. Joint Property Interest. Each IJV participant contributes property, cash, or other assets and organizational capital for the pursuit of a common and specific business purpose. Thus, an IJV is not merely a contractual relationship, but rather the contributions are made to a newly formed business enterprise, usually a corporation, limited liability company, or partnership. As such, the participants acquire a joint property interest in the assets and subject matter of the IJV. Reasons for Forming a Joint Venture There are many motivations that lead to the formation of a JV. They include: Risk Sharing – Risk sharing is a common reason to form a JV, particularly, in highly capital intensive industries and in industries where the high costs of product development equal a high likelihood of failure of any particular product. Economies of Scale – If an industry has high fixed costs, a JV with a larger company can provide the economies of scale necessary to compete globally and can be an effective way by which two companies can pool resources and achieve critical mass. Market Access – For companies that lack a basic understanding of customers and the relationship/infrastructure to distribute their products to customers, forming a JV with the right partner can provide instant access to established, efficient and effective distribution channels and receptive customer bases. This is important to a company because creating new distribution channels and identifying new customer bases can be extremely difficult, time consuming and expensive activities. Geographical Constraints – When there is an attractive business opportunity in a foreign market, partnering with a local company is attractive to a foreign company because penetrating a foreign market can be difficult both because of a lack of experience in such market and local barriers to foreign-owned or foreign-controlled companies. Funding Constraints – When a company is confronted with high up-front development costs, finding the right JVP can provide necessary financing and credibility with third parties. Benefits Many of the benefits associated with International Joint Ventures are that they provide companies with the opportunity to obtain new capacity and expertise and they allow companies to enter into related business or new geographic markets or obtain new technological knowledge. Furthermore, International Joint Ventures are in most cases have a short life span, allowing companies to make short term commitments rather than long term commitments. Through International Joint Ventures, companies are given opportunities to increase profit margins, accelerate their revenue growth, produce new products, expand to new domestic markets, gain financial support, and share scientists or other professionals that have unique skills that will benefit the companies. Structure International Joint Ventures are developed when two companies work together to meet a specific goal. For example, Company A and Company B first begin by identifying and selecting an IJV partner. This process involves several steps such as market research, partner search, evaluating options, negotiations, business valuation, business planning, and due diligence. These steps are taken on by each company. There are also legal procedures involved such as IJV agreement, ancillary agreements, and regulatory approvals. Once this process is complete, the IJV Company is formed and during this final procedure the steps taken are formation and management. Management There are two types of International Joint Ventures: dominant parent and shared management. Within dominant parent IJV’s, all projects are managed by one parent who decides on all the functional managers for the venture. The board of directors, which is made up of executives from each parent, also plays a key role in managing the venture by making all the operating and strategic decisions. A dominant parent enterprise is beneficial where an International Joint Venture parent is selected for reasons outside of managerial input. Finance When two or more partners get together and form an International Joint Venture agreement, they must decide early on in regards to what the financial structure will entail as this will aid in management and control. Some of the steps include establishing the capital required to start the IJV, the impact of securing a strong strategic alliance partner, and financial reporting. Once an arrangement is made, a tax-planned joint venture will be created which will aid in maximizing the after-tax returns. Factors affecting IJV Economic Factors Poor formation and planning Problems that arise in joint ventures are usually as a result of poor planning or the parties involved being too hasty to set up shop. For example, a marketing strategy may fail if a product was inappropriate for the joint venture or if the parties involved failed to appropriately asses the factors involved . Parties must pay attention to several analysis both of the environment and customers they hope to operate in. Failure to do this sets off a bad tone for the venture, creating future problems. Unexpected poor financial performance One of the fastest ways for a joint venture is financial disputes between parties. This usually happens when the financial performance is poorer than expected either due to poor sales, cost overruns or others. Poor financial performance could also be as a result of poor planning by the parties before setting up a joint venture, failure to approach the market with sufficient management efficiency and unanticipated changes in the market situation. A good solution to this is to evaluate financial situations thorough before and during very step of the joint venture. Management problems One of the biggest problems of joint ventures is the ineffective blending of managers who are not used to working together of have entirely different ways of approaching issues affecting the organization. Cultures Factors When a joint venture is formed, it is literarily an attempt at blending two or more cultures in the hope of leveraging on the strength of each party. Lack of understanding of the cultures of the individual parties poses a huge problem if not addressed. A common problem in these multi-cultural enterprises is that the culture is not considered in their initial formation. It is usually assumed that the cultural issues will be addressed later when the new unit has been created. Usually, compromises are reached and certain cultural from the parties are kept on while others are others are either out rightly discarded or modified. Pros and Cons for IJV The joint venture is becoming a popular way for companies that outsource their operations to retain a piece of the ownership pie. The creation of a new legal entity during the launch of a joint venture comes with its share of ups and downs. On the plus side: Joint ventures enable companies to share technology and complementary IP assets for the production and delivery of innovative goods and services. Joint ventures can be used to reduce political friction and improve local/national acceptability of the company. Joint ventures may provide specialist knowledge of local markets, entry to required channels of distribution, and access to supplies of raw materials, government contracts and local production facilities. In a growing number of countries, joint ventures with host governments have become increasingly important. These may be formed directly with State-owned enterprises or directed toward national champions. On the minus side: A major problem is that joint ventures are very difficult to integrate into a global strategy that involves substantial cross-border trading. In such circumstances, there are almost inevitably problems concerning inward and outward transfer pricing and the sourcing of exports, in particular, in favor of wholly owned subsidiaries in other countries. Problems occur with regard to management structures and staffing of joint ventures. Many joint ventures fail because of a conflict in tax interests between the partners. Disputes & Agreements Disputes When two or more partners agree on an International Joint Venture, there are possibilities for disputes to arise. Particularly in IJV’s, there can be issues between the partners who are likely to want their home country’s governing law and jurisdiction to apply to any disputes that may come up; therefore, to avoid such a problem, a neutral governing law and jurisdiction is chosen in some cases. A popular dispute resolution technique used in IJV’s is arbitration; however, many times a court process is given priority as this system has more authority. Other dispute resolution strategies utilized are mediation and litigation. Agreements Entering into an International Joint Venture agreement begins with the selection of partners and then generally this process continues to a Memorandum of Understanding or a Letter of Intent is signed by both parties. The Memorandum of Understanding is a document describing an agreement between parties. On the other hand, a Letter of Intent is a document outlining an agreement between the parties before the agreement is finalized. Examples of successful IJV Sony-Ericsson is a joint venture by the Japanese consumer electronics company Sony Corporation and the Swedish telecommunications company Ericsson to make mobile phones. The stated reason for this venture is to combine Sony’s consumer electronics expertise with Ericsson’s technological leadership in the communications sector. Both companies have stopped making their own mobile phones. Omega Navigation Enterprises Inc. is an international provider of marine transportation services focusing on seaborne transportation of refined petroleum products. One of the vessels, namely the Omega Duke, is owned through a 50% controlled joint venture with Topley Corporation, a wholly owned subsidiary of Glencore International AG (Glencore).They have also formed an equal partnership joint venture company with Topley Corporation, namely Megacore Shipping Ltd.

Step One: Preregister patients-Patients who call in order to schedule an appointment have to provide basic information. General information usually includes the person’s first, middle, and last names along with their address, the reason for the encounter, their basic insurance information, and the most convenient date and time of the appointment. During the encounter: Step Two: Establish financial responsibility-The person behind the window will inform the patient on whether or not they are eligible for that specific health plan, check the factors that are covered under that health plan, determine the first payer if there are more than one health plan that actually covers that patient, and meet the payer’s conditions for the payment. Step Three: Check in patients-Returning patients are required to sign in at the front desk of the facility. They usually are asked to review previous information to make sure that it is accurate and up-to-date. Their financial records are also checked to make sure that previous balances were paid at the time of the previous visits. If a new patient arrives, they are required to fill out a form that includes their personal information and show proof of their identification as well as proof of their insurance. This helps to eliminate fraud or malpractice in the facility. The patient’s personal information and insurance information will then be copied and returned to the patient. This information is entered into the facility’s database for future reference. The front and back of the insurance cards and other identification cards are scanned and copied in order to be storied in the database. Copayments are always collected at the time of the service, some are collected before the encou nter and some are collected after the encounter. Some facilities  require other forms to be completed by the patients, these forms are included as part of the process of recording administrative and clinical facts about patients. Step Four: Review Coding Compliance-In order for billing options to be carried out to the patient, medical codes must assign the medical procedures and diagnoses. The physician does specific codes for specific treatments and procedures. The treatment that the patient receives from the physician is entered into the database. The treatment and procedures that the patient receives have to be completed and signed by the physician. At the end of the patient’s visit, the physician gives the form (with the checked-off treatments and procedures) to the individual at the front desk. That person then in turn gives the form to the billing function of the facility. After this is done, they set up a patient’s next appointment. Step Five: Review Billing Compliance-After the facility transfers the patient’s diagnoses and procedures to billing, the file is then checked by billing in order to determine if the specific billing options are correct or not, and to make sure that reimbursements are returned to the patient in a timely fashion. Every fee or charge has its own specific procedure code. Usually, the physician’s charges are applied to the medical practice’s fee schedule.

Political Theory and the Great Gatsby

In his article â€Å"‘A New World, Material Without Being Real': Fitzgerald's Critique of Capitalism in The Great Gatsby,† Ross Posnock establishes Fitzgerald's interest in Marxism by placing him as a Nietzschean Marxist and contemporizing him with Georg Lukacs's History and Class Consciousness, printed in 1923, and with Marx's theories by extension, attempting to â€Å"demonstrate how deeply Marx's critique is assimilated into the novel's imaginative life,† although he is careful to point out that Fitzgerald â€Å"does not share their abhorrence of capitalism† [201]. Posnock offers a close reading of material objects and Gatsby's subsequent mystification with them to analyze the conflict between the individual and society, Nietzsche and Marx. I would suggest a revision to Posnock's analysis of The Great Gatsby, reidentifying the material world Posnock places as â€Å"Gatsby's† as that of the Buchanans, with Gatsby an implicit imposter. As Habermas summarizes, Nietzsche's theory of knowledge is replaced by a perspectival theory of the affects whose highest principle is â€Å"that every belief, every taking-for-true, is necessarily false because there is no true world† [Habermas 122]. In analyzing the material acquisitions of Gatsby, Posnock seems to demonstrate how Gatsby attempts to create himself, to make his world real, through the material values of the Buchanans. Yet his past and his characteristics, his â€Å"old sport† catchphrase, are all a smokescreen diverting us from knowing the true character of Gatsby. Nietzsche would seem to offer the explanation that there is no real Gatsby. Coppola similarly provides a material reading of Gatsby in the opening sequence of his screenplay, as he moves the audience from Gatsby's cars to his concert Steinway, crystal decanters, a toilet set of pure dull gold, rows and rows of fine suits (plus one military uniform), and an emerald ring [Coppola 1-3]. Posnock and Coppola seem to see a system of material enclosure created by the Tom Buchanans of the world, the American aristocracy, complete with moral values. The system has created the parameters by which Gatsby may define himself, by his possessions. Reexaminations of Marxism, such as the thought of Jurgen Habermas, investigates the social and cultural implications about which Marx wrote, allowing for deeper analysis than Posnock's superficial offering. If my understanding is correct, in Legitimation Crisis, Habermas looks at socio-cultural crisis tendencies and how they reflect political and economic systems crises, saying that input crises of the socio-cultural system are output crises of economic and political systems, or that the crises of the political and economic systems manifest themselves through the socio-cultural system. Thus, the crisis of an impostor illegally climbing the class hierarchy, acquiring power and influence, manifests itself socially, in the conflict between Tom and Gatsby for Daisy's love. But this social crisis has political and economic consequences as well, reflected through our narrator. According to Habermas, â€Å"In advanced capitalism, [changes in the socio-cultural system] are becoming apparent at the level of cultural tradition (moral systems, world views) as well as at the level of structural change †¦ and core components of the bourgeois ideology become questionable (endangering civil and familial-professional privatism)† [48-49]. The socio-cultural system lagged behind while the economic system moved from traditional to liberal capitalism (laissez-faire capitalism). As the economic system moved into advanced capitalism with the power of the Progressives (beginning with Theodore Roosevelt), the socio-cultural system caught up as well, forcing changes in input from the political system. Consequently, the political system has interfered more with civic privatism, including the New Deal and Lyndon Johnson's â€Å"Great Society† programs, in a search to build new, satisfactory normative structures while older but imperative normative structures, like education, have lagged behind, jeopardizing the economic system. The Great Gatsby is set at the socio-cultural junction that Habermas describes. Essentially, our nation was coming of age, and the booming period of the 1920s could be interpreted as a dysfunctional attempt to enjoy the newly-available economic riches. In terms of Gatsby, the conflict between Gatsby and Buchanan really focuses on Nick Carraway, our narrator. In the same way that Gatsby has already chosen to define himself via the social norms established, Nick must now also decide how to define himself as he claims his voice as narrator. According to Judith Butler, who is interpreting Lacan, â€Å"Entrance into language comes at a price: the norms that govern the inception of the speaking subject differentiate the subject from the unspeakable, that is, produce an unspeakability as the condition of subject formation† [Butler 135]. We encounter Nick after his coming of age, marked by his 30th birthday on the evening of Tom and Gatsby's confrontation, a day when â€Å"the transition from libertine to prig was so complete† [Fitzgerald 137], after he is allowed a voice. In fact, Carraway is only offered the opportunity to speak by his laissez-faire reaction to the moral dilemma. According to Butler: Although psychoanalysis refers to this inception of the subject as taking place in infancy, this primary relation to speech, the subject's entry into language by way of the originary ‘bar' is reinvoked in political life when the question of being able to speak is once again a condition of the subject's survival. The question of the ‘cost' of this survival is not simply that an unconscious is produced that cannot be fully assimilated to the ego, or that a ‘real' is produced that can never be presented within language. The condition for the subject's survival is precisely the foreclosure of what threatens the subject most fundamentally; thus, the ‘bar' produces the threat and defends against it at the same time [135]. The conflict of The Great Gatsby, if we apply Butler, focuses on Nick Carraway through the threat of Jay Gatsby's impediment on social hierarchy. The foreclosure of the threat, the execution of Gatsby, presents the ‘bar', the moral dilemma to which Nick must react. According to Saussure, â€Å"The social uses of language owe their specifically social value to the fact that they tend to be organized in systems of difference †¦ which reproduce †¦ the system of social difference. †¦ To speak is to appropriate one or another of the expressive styles already constituted in and through usage and objectively marked by their position in a hierarchy of styles which expresses the hierarchy of corresponding social groups† [Butler 157]. As Butler points out, Saussure is rehabilitating the base/superstructure model through the relationship of language and the social system [Butler 157]. The fight of Gatsby is really over cultural norms, and how Nick reacts in the last chapter is essential to the American future, in terms of Habermas, but also presents the threat of Nick being cast into the realm of the unspeakable. In his final encounter with Jordan Baker, Nick learns that turning 30, with the â€Å"portentous menacing road of a new decade† before him [Fitzgerald 143], comes final responsibility in speaking. When he says to her, â€Å"I'm thirty. †¦ I'm five years too old to lie to myself and call it honor† [Fitzgerald 186], Nick realizes he insults Jordan, casting her into the unspeakable by citing their age difference: â€Å"She didn't answer. Angry, and half in love with her, and tremendously sorry, I turned away† [Fitzgerald 186]. Not knowing exactly how he feels about Jordan and speaking without knowing, Nick comes to understanding the importance of speech through the guilt and shame he feels. That his ambivalent feelings toward Jordan, being half in love with her, mirror his feelings toward Gatsby, the contradictions that Donaldson points out would indicate that Nick comes to an informed decision about Gatsby before telling the story. At some point between Nick telling Gatsby â€Å"They're a rotten crowd. †¦ You're worth the whole damn bunch put together† [Fitzgerald 162] and telling the reader, â€Å"I disapproved of him from beginning to end† [Fitzgerald 162], one sentence later, Nick came to a moral understanding with socio-cultural and political implications.

Are Parents the Best Teachers?

Obviously, the first teachers we have in our lives in most cases are our parents. They teach us to walk, to speak, and to have good manners before we reach â€Å"the real world. † More than even the professional teachers that we have in school, parents are generally the most involved in the development and education of children. Almost for sure our parents are the best teachers at the beginning of our lives, which actually corresponds to the parents' role in nature. Parents are most committed and involved in teaching their children; they have a kind of instinct to sacrifice a part of themselves for the betterment of their children.They love us and have great patience while passing down their knowledge to us. They wish us a success and thus will not teach us bad things. And of course, implicit learning occurs when children unconsciously copy some of their parents' habits and styles of behavior. During the second stage of child development, adolescence, parents can still be in t he best position to offer advice even though the children might not accept it. In this case, perhaps the child's friends would be the best teachers. Adolescents are notoriously rebellious in many cultures and may automatically reject any advice from their parents.My first marriage for instance, was solely a matter of doing the opposite when my parents tried to intrude in offering their advice. So in such matters, parents should be much more flexible and be rather the partners with their children. So we can see that being a teacher of growing child become more and more complicated case as the time passes and many parents are simply not able to meet the increased demands. On the other hand, I would say that parents are not professional teachers and they tend to be very biased by their love of their children.So wishing good things and an easy life may prevent children from maturation. In any case, parents usually can present only one viewpoint of the world, while good teaching should b e based on different attitudes. Thus, when children go to school and have a great diversity of teachers, they learn much more than their parents could probably give them. Furthermore, once our parents get older, they become more conservative and cannot always be objective in regard to modern trends and fashions. Thus we need to take their advice with caution during that period.However, some kind of intuition which I believe shared between relatives about what everybody needs and great love which exists in a families still makes our parents very good teachers and advisers at any time. In conclusion, while parents are not the ideal teachers, and well-rounded children will generally need a great diversity of teachers in their lives in order to have a more accurate view of the world, parents are generally the most committed of all teachers and have the greatest emotional investment in their children and their future.
